THAT GUY EXTERIOR CLEANING

These Master Terms and Conditions (“Terms”) form part of every estimate, quote, work order, recurring service agreement, invoice, and other service agreement issued by Christopher Joseph Kolakowski, doing business as That Guy Exterior Cleaning (“Company,” “we,” “us,” or “our”). The person or entity requesting, approving, or receiving services is the “Client,” “you,” or “your.”

By electronically approving an estimate, paying a deposit, requesting that work be scheduled, authorizing work to begin, or otherwise accepting the Services, the Client acknowledges that the Client has read, understood, and agreed to these Terms.

ARTICLE 1 — GENERAL TERMS

1.1 Services and Service Agreement

“Services” means only the pressure washing, soft washing, exterior building washing, hard-surface cleaning, and exterior window cleaning services identified in the applicable estimate, quote, work order, or invoice.

The “Service Agreement” consists of these Terms together with the applicable estimate, quote, work order, recurring service agreement, invoice, approved change order, and any written special instructions accepted by the Company. The specific Service Agreement controls as to scope, price, service date, and any expressly conflicting term.

Any service, treatment, surface, building elevation, window, screen, stain-removal procedure, sealing, sanding, repair, restoration, or return visit not specifically listed in the Service Agreement is excluded.

1.2 Residential and Commercial Clients

A “Residential Client” is an individual obtaining Services primarily for personal, family, or household purposes.

A “Commercial Client” is a business, property owner, property manager, homeowners association, landlord, contractor, government entity, or other organization obtaining Services primarily for business, commercial, rental, association, or investment-property purposes.

A person approving Services for property owned or controlled by another person represents that the person has authority to approve the Services, grant access, and bind the responsible Client.

1.3 Estimates, Scope Changes, and Hidden Conditions

Estimates are based on the conditions reasonably visible or disclosed when the estimate is prepared. The Company may revise the price or scope when actual conditions materially differ from the information provided or when hidden conditions, additional square footage, restricted access, excessive buildup, specialty stains, unusual safety requirements, or additional requested work are discovered.

No additional work will be performed without the Client’s approval, except for minor steps reasonably necessary to complete the approved Services safely and properly. Approval may be written, electronic, or verbal when documented by the Company.

1.4 Payment Terms

Unless the Service Agreement states otherwise, payment is due immediately upon completion of the Services.

Commercial credit terms apply only when expressly approved in writing. If written net terms are approved, payment is due within the period stated in the Service Agreement.

The Company may require a deposit to reserve a service date, purchase materials, arrange specialty equipment, or schedule labor. Deposits will be applied to the final balance. A deposit may be retained as provided in the cancellation section below.

The Client authorizes charges only as expressly approved through the estimate, invoice, payment link, written authorization, or other affirmative payment authorization. Payment information is processed and stored, if applicable, by a third-party payment processor. The Company does not retain complete payment-card or bank-account numbers on its own systems.

Past-due balances may accrue a late charge of one and one-half percent (1.5%) per month, or the maximum lawful rate if lower, beginning after the due date. Returned-payment charges, chargeback costs, and similar third-party fees actually incurred by the Company may be added to the balance to the extent permitted by law.

The Client is responsible for reasonable collection costs to the extent permitted by applicable law. For a Commercial Client only, a reciprocal prevailing-party attorneys’ fee provision applies only when the applicable business contract is signed or electronically executed by both parties and only to the extent enforceable under North Carolina law. This attorneys’ fee provision does not apply to a Residential Client.

1.5 Cancellation, Rescheduling, and No-Access Visits

The Client must provide at least twenty-four (24) hours’ notice to cancel or reschedule.

For a cancellation made with less than twenty-four (24) hours’ notice, a no-show, or a visit where the Company cannot obtain required access, the Company may retain the deposit or charge a cancellation fee of seventy-five dollars ($75.00) for a Residential Client or one hundred fifty dollars ($150.00) for a Commercial Client. The parties agree that this amount is a reasonable estimate of administrative costs, travel, labor allocation, and lost scheduling opportunity, and is not intended as a penalty.

The first rescheduling request made with timely notice will not incur a fee. Repeated rescheduling, repeated access failures, or three or more cancellations within twelve months may require full prepayment before future scheduling.

The Company may reschedule because of weather, unsafe conditions, equipment failure, illness, supply interruption, or another circumstance reasonably affecting safety or service quality. No cancellation fee applies when the Company reschedules.

1.6 Client Preparation and Access Responsibilities

Before the scheduled arrival time, the Client must:

a. Provide safe, legal, and unobstructed access to the Service Area;

b. Unlock gates and provide necessary gate, parking, alarm, or access instructions;

c. Remove vehicles, furniture, grills, decorations, planters, toys, hoses, and other movable items from the Service Area;

d. Close and securely latch all windows, doors, vents, and other exterior openings;

e. Keep children, occupants, customers, employees, and animals away from the Service Area;

f. Identify fragile items, damaged surfaces, known leaks, defective outlets, security devices, irrigation equipment, underground features, ponds, wells, septic components, and other known hazards;

g. Disclose recent painting, staining, sealing, repairs, construction, chemical treatments, or other conditions that may affect the Services;

h. Identify particularly valuable, sensitive, recently planted, diseased, drought-stressed, or irreplaceable landscaping; and

i. Provide any other preparation specifically stated in the Service Agreement.

The Company is not responsible for delay, incomplete work, damage, or added cost caused by the Client’s failure to complete required preparation. The Company may skip inaccessible or unsafe areas, charge a reasonable return-trip fee, or treat the visit as a no-access cancellation.

1.7 Water and Utility Access

Unless the Service Agreement states that the Company will supply water, the Client must provide an adequate, continuous, functioning exterior water source reasonably accessible to the Service Area. The Client authorizes the Company to use the property’s water supply for the Services.

If the available water source, water pressure, flow rate, or access is inadequate, the Company may modify the work method, reschedule, charge an agreed water-supply or return-trip fee, or decline the affected Services.

1.8 Right to Refuse or Stop Work

The Company may refuse, suspend, or discontinue Services when, in its reasonable judgment:

a. The property or Service Area is unsafe;

b. The requested method is likely to damage the property;

c. Hazardous substances, unstable structures, aggressive animals, exposed electrical hazards, unsafe traffic, or other material hazards are present;

d. Required access, water, preparation, permission, or payment is not provided;

e. The Client or another person interferes with the work or directs unsafe conduct;

f. The Client engages in threatening, abusive, discriminatory, or harassing conduct; or

g. Continuing the Services would violate law, manufacturer guidance, insurance requirements, or accepted safety practices.

The Client remains responsible for completed work, mobilization, approved materials, and applicable cancellation or service-call charges.

1.9 Weather and Force Majeure

The Company is not liable for delay or nonperformance caused by rain, wind, lightning, freezing temperatures, extreme heat, natural disaster, fire, utility failure, road closure, government action, labor interruption, public emergency, supply disruption, or another event beyond the Company’s reasonable control.

The Company will make reasonable efforts to reschedule affected Services. Weather-related rescheduling by the Company does not constitute a breach and does not create a right to consequential damages.

1.10 Photographs and Service Documentation

The Company may take photographs or video before, during, and after the Services for condition documentation, quality control, safety, training, claim evaluation, and proof of performance.

The Company will not use images that reasonably identify the Client or reveal sensitive personal information for advertising without permission. Non-identifying before-and-after images may be used for portfolio or marketing purposes unless the Client opts out in writing before the Services begin.

ARTICLE 2 — RISK, DAMAGE, AND LIABILITY

2.1 Pre-Existing Conditions

A “Pre-Existing Condition” is any defect, damage, weakness, deterioration, installation problem, age-related condition, prior repair, prior coating, hidden condition, or material sensitivity that existed before the Services.

Examples include, without limitation:

a. Loose, oxidized, chalking, peeling, blistering, cracked, or deteriorated paint or coating;

b. Rotted, warped, split, sun-damaged, or water-damaged wood;

c. Loose siding, trim, mortar, caulk, glazing, stucco, EIFS, brick, stone, pavers, or concrete;

d. Cracked, chipped, pitted, spalled, etched, patched, improperly cured, or previously damaged concrete or masonry;

e. Deteriorated seals, flashing, weatherstripping, vents, windows, doors, screens, or exterior electrical components;

f. Failed insulated-glass seals, scratched or etched glass, damaged low-emissivity coatings, hard-water etching, or fabrication debris;

g. Defective installation, manufacturer defects, prior improper cleaning, and concealed damage;

h. Aging surfaces that cannot withstand ordinary professional cleaning; and

i. Stains, discoloration, or damage concealed by dirt, algae, mold, mildew, oxidation, paint, or debris.

Cleaning may reveal a Pre-Existing Condition that was previously hidden or less visible. The discovery or increased visibility of a Pre-Existing Condition is not damage caused by the Company.

2.2 Assumption of Inherent Cleaning Risks

The Client understands that exterior cleaning necessarily involves water, pressure, cleaning solutions, hoses, ladders, poles, surface cleaners, and other equipment. Even when proper methods are used, aged, defective, improperly installed, or compromised materials may change, fail, leak, shed, discolor, or become more visibly damaged.

The Client accepts the ordinary and inherent risks of cleaning the surfaces approved in the Service Agreement, subject to the Company’s duty to perform the Services with reasonable care.

2.3 Limitation of Liability

The Company is responsible for direct physical property damage proven to have been caused by the Company’s negligent performance of the Services.

To the fullest extent permitted by law, and except for liability that cannot lawfully be limited, the Company’s aggregate liability arising from a specific Service will not exceed the amount actually paid to the Company for that specific Service.

The Company is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of use, loss of rent, lost profits, business interruption, diminished reputation, or loss of anticipated savings.

These limitations do not apply to the extent a loss is caused by the Company’s gross negligence, willful misconduct, or another basis that applicable law does not permit the parties to limit.

2.4 Client-Caused and Third-Party Conditions

The Company is not responsible for loss or damage caused by:

a. Inaccurate or incomplete information supplied by the Client;

b. Failure to close openings, move items, disclose hazards, protect sensitive property, or follow preparation or aftercare instructions;

c. Conduct of occupants, tenants, customers, contractors, vendors, neighbors, animals, or other third parties;

d. Defective construction, installation, maintenance, repair, drainage, sealing, electrical work, irrigation, or waterproofing;

e. Weather or events occurring after the Services; or

f. Unauthorized alteration, repair, or cleaning performed after the Services.

2.5 Damage Reporting and Inspection

The Client must report alleged property damage as soon as reasonably possible and preferably within forty-eight (48) hours after completion. A report should include a description, photographs, the time of discovery, and relevant supporting information.

The Company must be given a reasonable opportunity to inspect the alleged damage before repair, replacement, disposal, additional cleaning, or alteration. Failure to provide prompt notice or a reasonable inspection opportunity may reduce or defeat a claim to the extent the delay materially prejudices the Company’s ability to investigate.

If the Company determines that direct physical damage was caused by its negligence, the Company may elect to repair the damage, arrange repair through a qualified contractor, replace the damaged item with a reasonably comparable item, or provide reasonable monetary compensation.

2.6 Insurance

The Company maintains commercial general liability insurance and any other insurance required by applicable law. A certificate of insurance may be provided upon written request.

2.7 Limited Client Indemnity

To the extent permitted by law, the Client will indemnify and hold the Company harmless from third-party claims arising from the Client’s lack of authority to approve the Services, the Client’s breach of these Terms, undisclosed hazards under the Client’s control, or the Client’s negligent or unlawful conduct.

This section does not require the Client to indemnify the Company for loss caused by the Company’s own negligence, gross negligence, or willful misconduct.

ARTICLE 3 — PRESSURE AND SOFT WASHING TERMS

3.1 Cleaning Method

The Company will select the equipment, pressure, temperature, detergents, cleaning solutions, dwell time, and process reasonably appropriate for the surface and condition.

“Pressure washing” may include high-pressure or moderate-pressure cleaning of suitable hard surfaces. “Soft washing” and “exterior building washing” use lower pressure with cleaning solutions for siding and other surfaces that may be damaged by high pressure.

The Client may identify concerns and desired results, but the Company is not required to use a method that it reasonably believes is unsafe, ineffective, inconsistent with manufacturer guidance, or likely to cause damage.

3.2 Included Surfaces

Pressure and soft washing may include only the surfaces expressly listed in the Service Agreement, such as:

a. Driveways, parking areas, sidewalks, walkways, patios, porches, and pool decks;

b. Concrete, brick, masonry, pavers, retaining walls, and similar hardscapes;

c. Exterior siding, trim, soffits, fascia, gutters, and building surfaces;

d. Decks, fences, and selected wood or composite surfaces;

e. Dumpster pads and commercial hardscapes; and

f. Other specifically identified exterior surfaces.

Roof washing is not included unless it is expressly listed as a separate service in the Service Agreement.

3.3 Cleaning Solutions and Landscaping

The Services may use sodium hypochlorite, surfactants, detergents, degreasers, rust-removal products, or other professional cleaning agents appropriate for exterior use.

The Company will take reasonable measures to control application, rinse affected areas, and protect nearby landscaping. However, chemical-sensitive surfaces and vegetation may be affected, especially when plants are unhealthy, recently planted, drought-stressed, unusually sensitive, not disclosed, or too close to the Service Area to avoid incidental contact.

The Client must identify sensitive landscaping, vegetable gardens, ponds, water features, unsealed decorative metals, specialty coatings, and other items requiring special protection before work begins.

Safety data sheets for cleaning products are available upon request.

3.4 Water Intrusion and Building Openings

The Client is responsible for ensuring that windows, doors, vents, exterior openings, weatherstripping, seals, flashing, and building-envelope components are closed and reasonably weather-tight.

The Company will use reasonable care to avoid water intrusion but is not responsible for intrusion caused by open windows or doors, defective seals, failed caulk, improper flashing, damaged siding, unsealed penetrations, or other Pre-Existing Conditions.

3.5 Concrete, Masonry, and Pavers

Pressure washing may reveal or increase the visibility of cracks, repairs, aggregate variation, stains, curing differences, oxidation, efflorescence, or inconsistent coloration.

The Company is not responsible for damage to weak, improperly cured, deteriorated, previously etched, spalled, patched, painted, sealed, or otherwise compromised concrete or masonry.

Cleaning pavers may remove loose joint sand, weeds, unstable material, or failing sealer. Re-sanding, sealing, leveling, repair, and replacement are not included unless separately listed.

The Company may decline or modify cleaning of newly poured, weak, or questionable concrete and masonry.

3.6 Wood, Composite, Painted, and Oxidized Surfaces

Wood cleaning may raise grain, create fuzzing, reveal weathering, loosen failing stain or paint, or produce color variation. Sanding, staining, painting, sealing, and restoration are excluded unless separately listed.

Oxidized or chalking siding, painted metal, gutters, trim, and other coated surfaces may show streaking, tiger striping, color variation, or coating removal when cleaned or touched. Standard washing is intended to remove organic growth and surface soil; it is not oxidation removal or paint restoration.

The Company may decline cleaning of surfaces with loose coatings or require written acknowledgment before proceeding.

3.7 Stains and Results

Standard pressure or soft washing is intended to remove ordinary dirt and organic growth. It does not guarantee complete removal of:

a. Oil, grease, transmission fluid, or petroleum stains;

b. Rust, battery acid, fertilizer, irrigation, or orange mineral stains;

c. Paint, tar, gum, adhesives, caulk, silicone, or construction residue;

d. Efflorescence, oxidation, artillery fungus, deeply embedded mold, or permanent discoloration;

e. Tire marks, leaf tannins, food stains, or dye transfer; or

f. Damage or staining that has chemically altered the surface.

Specialty stain treatment must be separately quoted. Specialty treatment may improve a stain without completely removing it, and color variation may remain.

3.8 Client Preparation for Pressure and Soft Washing

In addition to Article 1, the Client must:

a. Move vehicles far enough away to prevent overspray or chemical contact;

b. Remove or secure exterior furniture, grills, cushions, decorations, flags, and fragile items;

c. Retract or remove awnings and other movable coverings when requested;

d. Close windows and doors and notify occupants not to open them during service;

e. Turn off exterior fans, air intakes, or equipment when reasonably requested;

f. Keep people and animals indoors and away from hoses and treated areas; and

g. Notify the Company of surfaces that must not be cleaned or contacted.

3.9 Post-Service Conditions and Aftercare

Surfaces may remain wet or slippery after cleaning. The Client is responsible for restricting pedestrian and vehicle traffic until surfaces are reasonably dry and safe.

Some organic growth or discoloration may continue to lighten after treatment. The Client must follow reasonable aftercare instructions. The Company is not responsible for reduced longevity or altered results caused by failure to follow those instructions, irrigation, weather, new contamination, drainage problems, or recurring environmental conditions.

3.10 Commercial Pressure Washing

For Commercial Clients:

a. The Client must identify an authorized representative;

b. The Client is responsible for tenant, employee, customer, and vendor coordination;

c. The Client must provide traffic control, cones, barricades, or security unless the Service Agreement assigns that responsibility to the Company;

d. After-hours, weekend, lift, water-supply, recovery, or specialty-access charges may apply when listed in the Service Agreement; and

e. Recurring service may be governed by an additional written schedule or service plan.

ARTICLE 4 — EXTERIOR WINDOW CLEANING TERMS

4.1 Standard Scope

Unless the Service Agreement states otherwise, exterior window cleaning includes cleaning the exterior surface of accessible window glass only.

Exterior frames and exterior sills may be rinsed or wiped where reasonably accessible as part of the selected cleaning method, but detailed frame restoration, track cleaning, interior sill cleaning, interior glass cleaning, screen cleaning, screen removal, screen repair, and interior access are excluded unless specifically listed.

The Company may use traditional tools, ladders, extension poles, purified-water systems, water-fed poles, or another professional method selected for the property.

4.2 Excluded Conditions and Additional Services

The following are not included in standard exterior window cleaning unless separately listed and priced:

a. Hard-water, mineral, sprinkler, or irrigation stain removal;

b. Paint, stain, silicone, caulk, adhesive, tape, mortar, stucco, concrete, or construction debris removal;

c. Scraping or razor-blade restoration;

d. Oxidation removal from frames;

e. Screen removal, cleaning, repair, or replacement;

f. Storm-window disassembly;

g. Skylights, solar panels, mirrors, or interior glass;

h. Glass polishing, scratch removal, or restoration; and

i. Lift, scaffolding, roof, or specialty rope-access work.

The Company may decline scraping or construction-cleanup work because certain tempered, coated, filmed, defective, or fabrication-debris-contaminated glass may scratch during debris removal.

4.3 Access and Safety

The Client must provide safe exterior access, unlock gates, move furniture and planters, control animals, and disclose underground hazards, electrical hazards, unstable surfaces, and fragile landscaping.

The Company may exclude any window that cannot be safely reached using the equipment and methods available for the scheduled Service. Unsafe or inaccessible windows may be omitted without requiring the Company to use a ladder, roof, lift, or method not included in the Service Agreement.

Additional charges may apply for windows above the second story, unusually obstructed windows, lift access, specialty equipment, or a return visit required because access was unavailable.

4.4 Screens

Screens are excluded unless specifically listed. When screen removal or reinstallation is included, the Client acknowledges that aged, brittle, warped, corroded, sun-damaged, improperly fitted, or previously damaged screens and clips may tear, bend, break, or fail during ordinary handling.

The Company is not responsible for failure of a screen, frame, spline, clip, or fastener caused by a Pre-Existing Condition.

4.5 Glass, Seals, Coatings, and Pre-Existing Damage

The Client acknowledges that windows may contain or exhibit:

a. Failed insulated-glass seals or moisture between panes;

b. Scratches, chips, cracks, pitting, haze, etching, or mineral damage;

c. Damaged tint, film, low-emissivity coating, reflective coating, or aftermarket coating;

d. Loose glazing, deteriorated putty, defective frames, failed caulk, or leaking seals;

e. Fabrication debris or construction contamination; and

f. Prior improper cleaning or abrasive damage.

Cleaning may make these conditions more visible. The Company is not responsible for a Pre-Existing Condition or for seal failure, fogging, leakage, coating failure, or glass damage not caused by the Company’s negligence.

4.6 Purified-Water Cleaning

When purified-water or water-fed-pole cleaning is used, glass may remain wet and may show temporary water droplets immediately after service. Properly treated water is intended to dry without mineral spotting. The Client should allow the glass to dry fully before evaluating the result.

Water released from frames, seals, screens, vents, or surrounding surfaces after cleaning may cause isolated spotting outside the Company’s control. The Company will address qualifying service-quality concerns under the satisfaction provision below.

4.7 Hard-Water and Construction Debris

Hard-water stains and construction debris often require specialized chemicals, abrasives, or scraping and may be permanent. The Company does not guarantee complete removal.

When the Client authorizes specialized restoration or debris removal, the Client accepts the increased risk associated with previously damaged, coated, tempered, defective, or fabrication-debris-contaminated glass, except to the extent damage is caused by the Company’s negligence.

4.8 Weather

Exterior window cleaning may be rescheduled because of rain, lightning, high winds, freezing temperatures, extreme heat, or other conditions that materially affect safety or service quality. Weather-related rescheduling by the Company is not subject to a cancellation fee.

4.9 Exterior Window Cleaning Satisfaction Policy

The Client must report a service-quality issue involving an included exterior window within twenty-four (24) hours after completion and provide reasonable access for inspection.

If the issue resulted from incomplete or deficient cleaning by the Company, the Company will re-clean the affected exterior window at no additional charge. Re-cleaning is the exclusive service-quality remedy.

This policy does not cover windows that become soiled after service because of rain, irrigation, construction, landscaping, insects, occupants, contractors, leaking frames, defective seals, runoff from surrounding surfaces, or another external cause.

4.10 Commercial Exterior Window Cleaning

For Commercial Clients:

a. Service frequency and recurring pricing must be stated in writing;

b. The Client is responsible for tenant access, notices, alarm coordination, and keeping work areas reasonably clear;

c. After-hours or specialty-access charges may apply when listed;

d. Storefront service includes only the panes and exterior surfaces identified in the Service Agreement; and

e. A property manager or authorized representative may approve work for multiple locations through a written recurring service agreement or individual work orders.

ARTICLE 5 — PRIVACY, COMMUNICATIONS, AND RECORDS

5.1 Information Use

The Company may collect names, property addresses, telephone numbers, email addresses, access instructions, service history, property-condition information, photographs, and payment-related information needed to quote, schedule, perform, document, bill, and administer the Services.

The Company does not sell Client information for third-party marketing. Information may be shared with payment processors, scheduling and customer-management providers, insurers, subcontractors assisting with the Services, legal or accounting professionals, and government authorities when reasonably necessary or legally required.

5.2 Electronic Communications

The Client consents to receiving estimates, appointment notices, invoices, payment links, service updates, and other transactional communications by email, telephone, or text message at the contact information provided.

The Client must promptly update inaccurate contact information. Consent to transactional communications is not consent to receive unrelated marketing where separate consent is required by law.

ARTICLE 6 — DISPUTES AND LEGAL PROVISIONS

6.1 Good-Faith Resolution

Before filing a lawsuit, the parties will make a good-faith effort to resolve the dispute through written notice and direct discussion. The notice should describe the dispute and requested resolution.

This requirement does not prevent either party from pursuing a claim in small claims court, preserving a statute of limitation, seeking emergency or injunctive relief, filing an insurance claim, or pursuing lawful collection remedies.

6.2 Governing Law and Venue

North Carolina law governs the Service Agreement without regard to conflict-of-law rules.

Any court action arising from the Service Agreement must be filed in a court of competent jurisdiction serving Iredell County, North Carolina, unless applicable law requires another venue.

6.3 Lien and Collection Rights

The Company reserves any lien, claim, collection, or other remedy that is actually available under applicable law. Nothing in these Terms creates a lien where the law does not provide one.

6.4 Severability

If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent or modified as necessary to make it enforceable. The remaining provisions remain in effect.

6.5 No Waiver

A failure or delay in enforcing a provision does not waive that provision or any later breach. A waiver must be in writing.

6.6 Assignment

The Client may not assign the Service Agreement without the Company’s written consent. The Company may assign the Service Agreement to a lawful successor to the business, subject to applicable law.

6.7 Independent Contractor

The Company is an independent contractor. Nothing in the Service Agreement creates an employment, partnership, franchise, joint-venture, fiduciary, or agency relationship between the parties.

6.8 No Third-Party Beneficiaries

The Service Agreement is for the benefit of the Company and the Client only, except for lawful successors and permitted assigns.

6.9 Changes to These Terms

The version of these Terms accepted with the applicable Service Agreement governs that Service. The Company may update these Terms prospectively for future Services. An update does not retroactively change an already accepted Service Agreement unless both parties agree.

6.10 Entire Agreement and Order of Precedence

The Service Agreement is the complete agreement concerning the approved Services and replaces prior discussions or representations about those Services.

If documents conflict, the following order controls: (1) a signed or electronically accepted change order or special term; (2) the specific estimate, quote, work order, or recurring service agreement; (3) these Master Terms and Conditions; and (4) the invoice.

6.11 Electronic Acceptance and Signatures

Electronic approval, typed signatures, click-to-accept actions, payment of a deposit, and other affirmative electronic actions may be used to accept and execute the Service Agreement to the extent permitted by law.

6.12 Notices

A notice is effective when personally delivered, confirmed by email, or delivered by a recognized carrier or postal service to the address above.

ARTICLE 7 — CLIENT ACKNOWLEDGMENT

By accepting the Service Agreement, the Client acknowledges that:

a. The Client has reviewed and accepted the identified scope and price;

b. The Client has authority to approve the Services and grant access;

c. The Client understands that exterior cleaning can reveal Pre-Existing Conditions;

d. The Client will complete the required preparation and disclose known hazards and sensitive conditions;

e. Results depend on surface condition, age, material, staining, weather, and prior treatment;

f. Specialty stain removal, repairs, restoration, sealing, sanding, screen work, interior window cleaning, and unlisted services are excluded unless specifically stated;

g. The Client agrees to the payment, cancellation, risk, damage-reporting, and dispute provisions above; and

h. These Terms, together with the applicable Service Agreement, form the complete agreement between the parties.
